Terms of Use

These Terms of Use ("Terms") are an agreement between you and Boutanna Apps ("Boutanna Apps", "we", "us"), a company registered in the Republic of Türkiye. They apply to our website at boutannapps.com and our mobile applications, including Deadpoint and Getups (together, the "Services"). By downloading or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Using the apps

We grant you a personal, non exclusive, non transferable and revocable licence to use our apps on Apple devices that you own or control, as permitted by Apple's Usage Rules in the App Store Terms of Service. You agree not to copy, modify, reverse engineer, resell or misuse the apps, or interfere with their normal operation, except where the law allows it.

2. Subscriptions

Our apps are free to download and some, such as Deadpoint, offer optional premium subscriptions or in app purchases that unlock additional features. The options, prices and any free trial are always shown in the app before you buy.

• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period unless auto renew is turned off at least 24 hours before the current period ends.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.
• You can manage or cancel your subscription at any time in Settings, then your name, then Subscriptions on your iPhone. Cancelling stops future renewals; you keep access until the end of the period you paid for.
• If a free trial is offered, any unused part of it ends when you purchase a subscription.

All payments are processed by Apple, so refunds are handled by Apple under its policies at reportaproblem.apple.com. If we change subscription prices, Apple will notify you in advance as required, and you can decide whether to continue.

3. Your content and backups

You own the content you create in our apps, such as climbs and sessions in Deadpoint. Our apps store this content on your device, or in your own iCloud where an app offers sync. We do not keep a copy, so we cannot restore it if your device is lost, reset or the app is deleted. We recommend keeping your device backups turned on.

4. Climbing and physical activity

Deadpoint is a logging tool. It does not provide medical, safety, coaching or training advice, and the statistics it shows are for your information only. Climbing and other physical activities carry inherent risks of injury. You are solely responsible for your own safety, equipment, technique and decisions, and you should follow the rules of your gym or climbing area.

5. Apps in development

Apps that are in development, such as Getups, and any early access or beta versions may change, contain errors or be discontinued. Joining a waitlist does not create any obligation to release an app.

6. Intellectual property

The Services, including their software, design, text, graphics, logos and the Boutanna Apps, Deadpoint and Getups names and marks, belong to Boutanna Apps or its licensors and are protected by law. These Terms do not give you any right to use them other than to use the Services as intended.

7. Third party services

The Services rely on third party services such as the App Store, and link to third party websites. Their own terms and privacy policies apply, and we are not responsible for them.

8. Disclaimers

We work hard to keep the Services useful and reliable, but they are provided "as is" and "as available". To the extent permitted by law, we do not guarantee that they will be uninterrupted, error free or fit for a particular purpose.

9. Limitation of liability

To the extent permitted by law, Boutanna Apps is not liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of the Services, and our total liability for any claim is limited to the amount you paid for the relevant Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for intent or gross negligence, or your statutory rights as a consumer.

10. Apple

These Terms are between you and Boutanna Apps only, not Apple. Apple is not responsible for the apps or their content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the apps, including product liability, legal compliance or intellectual property claims. If an app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited parties. Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.

11. Ending use

You can stop using the Services at any time by deleting the apps and cancelling any subscription. We may suspend or end access to the Services if you seriously breach these Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the competent courts and enforcement offices of Türkiye. If you are a consumer, you may also apply to the Consumer Arbitration Committees or Consumer Courts where you live, and you keep any mandatory protections given by the law of your country of residence.

13. Changes

We may update these Terms from time to time. We will change the date at the top of this page and, for significant changes, let you know in the app. Continuing to use the Services after an update means you accept the revised Terms.
